Is Slovakia a migrants' friendly country?

Being a legal representative or a shareholder in a limited liability company is not a reason for being granted a permit for temporary stay.

As you are an owner of a temporary residence permit for the purpose of employment, you are allowed to request a permanent residence permit after 5 years of subsequent stay in Slovakia. a foreigner can be granted a permanent residence after at least 5 years of subsequent stay in SR (for the purposes of business and employment). Temporary residence permit is granted in shorter time only in case of family unification or re-unification.

Manželka je Ukrajinka a má na Slovensku trvalý pobyt od novembra 2007. Pracovala 9 mesiacov a bola v trvalom pracovnom pomere. Momentálne je nezamestnaná a starám sa o ňu opäť ja. Splňá podmienky na dávky, musíme ju na úrad práce prihlásiť?

Podla zákona o službách zamestnanosti, Vašamanželka po skončení pracovného pomeru do siedmich dní odo dna skončenia zamestnania, mohla požiadat príslušný urad práce a sociálnych vecí o zaradenie do evidencie uchádzačov o zamestnanie. /Može požiadat aj teraz./
V prípade, ak je fyzická osoba uchádzačom o zamestnanie, potvrdenie o zaradení do evidencie predloží svojej zdravotnej poistovni, potom zdravotné poistenie za nu platí štát.

Podla zákona o sociálnom poistení Vaša manželka po skončení zamestnania, keby ochorela v ochrannej lehote 42 kalendárnych dní po zániku nemocenského poistenia, mala nárok na nemocenské, /a to v prípade dlhodobej dočasnej pracovnej neschopnosti až počas obdobia maximálne 52 týždnov trvajucej celej podpornej doby , ak počas pracovného pomeru nebola dočasne práceneschopná/ od príslušnej pobočky Sociálnej poistovne.
V prípade, že v čase skončenia pracovného pomeru bola tehotná, ochranná lehota je v tom prípade šest mesiacov, nie iba 42 dní.

Podla zákona o sociálnom poistení može manželka pokračovat v nemocenskom poistení ako dobrovolne nemocensky poistená osoba, a v prípade vzniku dočasnej pracovnej neschopnosti , ošetrovania člena rodiny , materstva, bude mat nárok na materské, ošetrovné, nemocenské.
Suma poistného nie je taká vysoká ako pri dobrovolnom dochodkovom poistení.

Rovnako je možné v pobočke Sociálnej poistovne sa prihlásit aj na dobrovolné poistenie v nezamestnanosti, aj to zvážte, pretože podla v sučasnosti platnej legislatívy spravidla nárok na tuto dávku nevzniká, ak v posledných štyroch rokoch pred zaradením do evidencie uchádzačov o zamestnanie nebol poistenec aspon tri roky poistení v nezamestnanosti.

O dávke garančného poistenia zo Sociálnej poistovne nepíšem, pretože predpokladám, že nedošlo k nevyplateniu mzdy zo strany zamestnávatela, a nejde o zamestnávatela na ktorého bol podaný návrh na konkurz na príslušnom sude.

The process is as follows, you need your marriage letter to be endorsed by the Ministry of Foreign Affairs in China, then the SR representative office on the territory of China and then transferred to the court certified court translator, in order to be later on submitted to the Parish Registry by place of residence on the territory of SR, address of your stay in SR. Only the processing of documents on the territory of SR takes up to 3 months, however you must count on time spent for getting 2 certifying stamps in China. Can my friend, a holder of a Swiss residence card enter Slovakia without Schengen visa?
